Steven Moncado music & Strings studio policies
Payment Policy
I understand that payments can be made via cash or card. Reoccurring, monthly payments are available upon request. I understand that payment is required prior to each lesson or first Monthly Lesson Plan session. I understand that Monthly Lesson Plan payments are due on the 1st of each month. I understand that there will be a grace period between the 1st and 4th of the month.
Late Fee
I understand that a $20 late fee will automatically be applied to my account if I make payment after the due date and grace period given to me. I understand that if I do not make payment prior to my first scheduled lesson or Monthly Lesson Plan term, my lesson(s) will be cancelled until that payment is made. I understand that a make-up lesson is given at the sole discretion of the studio and/or instructor.
Cancellation Policy
I understand that a 48-hour notice of cancellation is required by 3pm to avoid being charged for said cancellation. I understand if 48-hour notice is given, make-up lessons may be offered at the sole discretion of the studio and/or instructor. If for some reason a make-up cannot be offered, the notice can be applied as a credit towards the student’s next payment.
Materials
I understand that students are expected to come to lessons prepared with the proper books and materials assigned from previous lessons. I understand if the student fails to come prepared on a reoccurring offense, the studio and/or instructor will reserve the right to ask the student to exit the current lesson without the possibility of a credit or a make-up.
Practice
I understand students are expected to practice all techniques, etudes (method materials), and pieces assigned by myself. I understand that without practice, it will be difficult for the student to make progress in an efficient manner. I understand that if the student fails to come with a lack of preparedness and/or progress, we will continue to repeat the same materials as needed.
Monthly Lesson Plan Cancellation
I understand that there is a 30-day notice regarding any Monthly Lesson Plan cancellations. If I fail to comply, I agree to be charged for the following month for the current amount without hesitation.
Email Subscription
I understand that I will automatically be added to Steven Moncado Music & Strings email campaign. I understand that I can unsubscribe at any time via the email campaign. I understand that if I need further assistance, I can reach out to the studio directly.
Photo/Video Release
I (the parent or legal guardian of my child) hereby grant permission to Steven Moncado Music & Strings, the rights of my/my child’s image, in a video or still, and of the likeness and sound of my/my child’s performance, voice as recorded on audio or video tape with without any other consideration. I understand that my/my child’s images and videos may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my/my child’s likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my/my child’s image or recording. I also understand that this material may be used in diverse educational settings.
By signing this release, I understand this permission signifies that photographic or video recordings of me/my child may be electronically displayed via the Internet or in the public educational setting.
I will be consulted about the use of the photographs or video recording for any other purpose.
There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.
This release applies to photographic, audio or video recordings collected as part of the sessions.
I understand that if I wish to not participate or govern my child’s decision to not participate, I must notify Steven Moncado Music & Strings.
By signing this electronic release, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against an person or organization utilizing this material for educational purposes.
WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT - COVID 19
In consideration for receiving permission to BE ON PREMISES AND PARTICIPATE WITH IN-PERSON LESSONS (hereinafter the “Activity or Activities”) at Steven Moncado Music & Strings (hereinafter SMMS), I, on behalf of myself and any minor child/children for whom I have the capacity to contract, hereby acknowledge and agree to the following:
1. I understand the hazards of the novel coronavirus (“COVID-19”) and am familiar with the Centers for Disease Control and Prevention (“CDC”) guidelines regarding COVID-19. I acknowledge and understand that that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates.
2. No withstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to participate in Activities.
3. I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the Activities and hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of myself and any minor children form whom I have the capacity contract) SMMS, their owners, officers, directors, agents, employees and assigns (the “RELEASEES”) from any liability related to COVID-19 which might occur as a result my being on the premises and participating in the Activities.
4. I shall indemnify, defend and hold harmless the RELEASEES from and against any and all claims, demands, suits, judgments, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees, costs and disbursements, whether of in-house or outside counsel and whether or not an action is brought, on appeal or otherwise), arising from or out of, or relating to, directly or indirectly, the infection of COVID-19 or any other illness or injury.
5. It is my express intent that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES. This Agreement and the provisions contained herein shall be construed, interpreted, and controlled according to the laws of the State of Washington. I HEREBY KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY DISPUTE ARISING IN CONNECTION WITH THIS AGREEMENT. I ACKNOWLEDGE THAT THIS WAIVER WAS EXPRESSLY NEGOTIATED AND IS A MATERIAL INDUCEMENT THE PERMISSION GRANTED BY RELEASEES TO BE ON PREMISES AND PARTICIPATE IN THE ACTIVITIES.
IN SIGNING THIS ELECTRONIC AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing
Wavier of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.
